<p><span class="EC_Apple-style-span" style="font-weight: bold;">Argumentix</span> is the ongoing solo project of Mr. James Squeaky, Portland, Oregon&#8217;s preeminent connoisseur of provocative culture and cuddly felines. &nbsp;He&#8217;s shrieked for the spastic hardcore band Alarmist!, puked forth a million oddball recordings and side projects, and also edited the fine fanzine and webzine Below PDX. &nbsp;In Argumentix, he swoons with faggy goth swagger fumbling over tape &amp; feedback loops leaving behind a rag-carpet of sound for us to marvel at. &nbsp;<br />

<p>Prior to classification, FDA has reopened the public comment period concerning the risks of dental amalgam with a deadline for submissions of July 28, 2008.</p>

<p><strong>BAN DENTAL AMALGAM FILLINGS NOW!</strong></p>
<p>Points to consider in your submission:</p>
<p>Dental amalgam must be classified as Class III, not Class II so that manufacturers have to prove the safety of amalgam. Class II does not require this regulation.<br />
Amalgam manufacturers should be mandated to provide an environmental impact statement to prove amalgams are environmentally safe. Mercury from dental offices contributes at least 40% of the mercury to wastewater, as well as contributing to air pollution from crematoriums.<br />
Include your personal stories including: dental revisions and additional dental costs due to corrosion and break down of amalgam fillings and health related illnesses and medical costs due to mercury toxicity. (Please do not include personal information such as social security numbers).<br />
This Spring we won a lawsuit against the FDA for not classifying dental amalgam after a 32 year stand off. As a result, FDA had to revise the information on their website related to the risks of dental amalgam, now admitting that amalgam fillings are a potential risk to pregnant women, children and a sensitive sub-population. <p><strong>Background:<br />
</strong><br />
Many people do not realize the &#8220;silver&#8221; amalgam fillings are 50% mercury. A large filling may contain as much mercury as a thermometer. Mercury vaporizes easily at room temperature, and in this state, is odorless, colorless and tasteless. Inhaled mercury vapor is readily absorbed into the bloodstream. The World Health Organization has concluded that dental fillings contribute more mercury to a person&#8217;s body than all other sources of mercury combined. Mercury is a powerful poison. Published research demonstrates that mercury is more toxic than lead, cadmium or arsenic. No amount of exposure to mercury vapor can be considered harmless. Especially considering its cumulative effect.</p>
<p>Mercury is the most toxic, non-radioactive element on the earth. Most medical and scientific researchers have called for a ban on the use of mercury in all products. However, the potential harmful effects of mercury fillings have been ignored by the U.S. Government. Due to its poisonous nature, mercury can adversely affect the immune, urinary, cardiac, respiratory and digestive systems. Under laboratory conditions, mercury has produced brain cell deterioration identical to that seen in victims of Alzheimer&#8217;s disease.</p>
<p><strong>Consumers for Dental Choice (CDC)</strong> was established in 1996 by consumer advocates, mercury poisoning victims, scientists and mercury-free dentists, and soon thereafter became a 501(c)(3) nonprofit corporation. Our purpose is to educate the public about the health and environmental dangers of mercury fillings, and to ensure more effective government oversight on amalgam. Since the organization began, the number of amalgams placed have declined dramatically, from two-thirds of all fillings placed to one-third, and the number of mercury-free dentists has grown dramatically. But we will not be satisfied until mercury is no longer used in dentistry.<br />
As part of its educational work, Consumers for Dental Choice wants the full flow of non-deceptive information between dentists and patients. As such, we work to end the American Dental Association’s notorious “gag rule” which tries to silence mercury-free dentists, and the ADA’s promoting mercury amalgam under the deceptive term “silver.” We favor full disclosure of the risks of mercury fillings.</p>
<p>It is important that research relied upon by federal agencies be based on science, so Consumers works to counter studies by non-independent or unqualified researchers that urge continuation of amalgam for spurious reasons such as “it’s good because we’ve used it for 150 years,” or a mixture of amalgam is like sodium and chloride is like table salt. Scientific research makes clear that mercury does not belong in dentistry.</p>
<p>The environmental dangers of mercury fillings – from dental offices, from human waste, and from cremation – is alarming, and reason enough to end the use of amalgam. Consumers works to educate the public about the contribution of dentistry of toxic mercury to both human beings and the environment.</p>
<p><strong>The International Academy of Oral Medicine and Toxicology<br />
</strong><br />
In 1984, thirteen dentists were discussing a seminar they had just attended on the dangers of mercury from dental amalgam fillings. They agreed that the subject was alarming. They also agreed that the seminar, though long on fireworks, was short on science, and if there really was a problem with dental mercury, the evidence ought to be in the scientific literature. So, like thirteen musketeers vowing “all for one and one for all,” they set out to find the evidence, or failing that, to sponsor new research that would provide the answers they sought.</p>
<p>Over two decades later, the IAOMT has grown to over 500 active members in North America, with affiliated chapters in fourteen other countries. The years have been very fruitful, as the Academy and its members have chronicled and promoted the research that has proven beyond a reasonable doubt that dental amalgam is a source of significant mercury exposure, and a hazard to health. It has taken the lead in educating dentists and allied professionals in the methods of safely dealing with amalgam fillings, and safely disposing the waste. It has also led the way in developing more biocompatible approaches in other areas of dentistry, including endodontics, periodontics, and disease prevention. All this while maintaining the motto, “Show me the science!”</p>
<p>A more biocompatible approach is the hallmark of &#8220;biological dentistry.&#8221; In using that term, we are not attempting to stake out a new specialty for dentistry, but to describe an attitude that can apply to all facets of dental practice, and to health care in general: to always seek the least toxic way to accomplish the mission of treatment, to do it while treading as softly as possible on the patient&#8217;s biological terrain.</p>

<p><strong>Department of Justice Fails to Appeal Dismissal<br />
Kurtz Speaks about Four-Year Ordeal</strong></p>
<p>Buffalo, NY&#8211;Dr. Steven Kurtz, a Professor of Visual Studies at SUNY at Buffalo and cofounder of the award-winning art and theater group Critical Art Ensemble, has been cleared of all charges of mail and wire fraud. On April 21, Federal Judge Richard J. Arcara dismissed the government&#8217;s entire indictment against Dr. Kurtz as &#8220;insufficient on its face.&#8221; This means that even if the actions alleged in the indictment (which the judge must accept as &#8220;fact&#8221;) were true, they would not constitute a crime. The US Department of Justice had thirty days from the date of the ruling to appeal. No action has been taken in this time period, thus stopping any appeal of the dismissal. According to Margaret McFarland, a spokeswoman for US Attorney Terrance P. Flynn, the DoJ will not appeal Arcara&#8217;s ruling and will not seek any new charges against Kurtz.</p>
<p>For over a decade, cultural institutions worldwide have hosted Kurtz and Critical Art Ensemble&#8217;s educational art projects, which use common science materials to examine issues surrounding the new biotechnologies. In 2004 the Department of Justice alleged that Dr. Kurtz had schemed with colleague Dr. Robert Ferrell of the University of Pittsburgh Graduate School of Public Health to illegally acquire two harmless bacteria cultures for use in one of those projects. The Justice Department further alleged that the transfer of the material from Ferrell to Kurtz broke a material transfer agreement, thus constituting mail fraud.</p>
<p>Under the USA PATRIOT Act, the maximum sentence for these charges was increased from five years to twenty years in prison.</p>
<p>Dr. Kurtz has been fighting the charges ever since. In October 2007, Dr. Ferrell pleaded to a lesser misdemeanor charge after recurring bouts of cancer and three strokes suffered since his indictment prevented him from continuing the struggle.</p>
<p><strong>KURTZ SUMS UP END OF FOUR-YEAR NIGHTMARE</strong></p>
<p>Finally vindicated after four years of struggle, Kurtz, asked for a statement, responded stoically: &#8220;I don&#8217;t have a statement, but I do have questions. As an innocent man, where do I go to get back the four years the Department of Justice stole from me? As a taxpayer, where do I go to get back the millions of dollars the FBI and Justice Department wasted persecuting me? And as a citizen, what must I do to have a Justice Department free of partisan corruption so profound it has turned on those it is sworn to protect?&#8221;</p>
<p>Said Kurtz&#8217;s attorney, Paul Cambria,  &#8220;I am glad an innocent man has been vindicated. Steve Kurtz stared in the face of the federal government and a twenty-year prison term and never flinched, because he believes in his work and his actions were those of a completely innocent man. Clients like him are a blessing, and although I have had many important victories, this one stands at the top of the list.&#8221;</p>
<p>As coordinator of the CAE Defense Fund, a group organized to support Kurtz from the beginning of the case, Lucia Sommer sees the end of the prosecution as bittersweet, and like Kurtz, is thoughtful about the broader significance of the case:  &#8220;This ruling is the best possible ending to a horrible ordeal&#8211;but we are mindful of numerous cases still pending, and the grave injustices perpetrated by the Bush administration following 9/11. This case was part of a larger picture, in which law enforcement was given expanded powers. In this instance, the Bush administration was unsuccessful in its attempt to erode Americans&#8217; constitutional rights.&#8221; </p>
<p>Referring to the international outcry the case provoked, involving fundraisers and protests held on four continents, Sommer said, &#8220;The government has unlimited resources to bring and prosecute these kinds of charges, but the accused often don&#8217;t have any resources to defend themselves. This victory could never have happened without the activism of thousands of people. Supporters protested, vocally opposed the prosecution, and refused to let it go on in silence. And without their efforts at fundraising, Kurtz and Ferrell would not have been able to defend themselves from these false accusations.&#8221;</p>
<p>Sommer added that the next step for the defense will be to get back all of the materials taken by the FBI during its 2004 raid on the Kurtz home, including several completed art projects, as well as Dr. Kurtz&#8217;s lab equipment, computers, books, manuscripts, notes, research materials, and personal belongings.  The four confiscated art projects are the subject of an exhibition entitled SEIZED on view at Hallwalls Contemporary Arts Center in Buffalo, NY, through July 18: <a href="http://www.hallwalls.org/visual_shows/2008/show_seized.html">http://www.hallwalls.org/visual_shows/2008/show_seized.html</a>.</p>
<p><strong>BACKGROUND TO THE CASE</strong></p>
<p>The case originated in May 2004, when Kurtz&#8217;s wife Hope died of heart failure as the couple was preparing a project about genetically modified agriculture for the Massachusetts Museum of Contemporary Art. Police who responded to Steve Kurtz&#8217;s 911 call deemed the Kurtzes&#8217; art materials suspicious and alerted the FBI. Kurtz explained that the materials (legally and easily obtained basic life science equipment and two harmless bacteria samples) had already been displayed at museums throughout Europe and North America with absolutely no risk to the public. However, the following day, Kurtz was illegally detained for 22 hours on suspicion of bioterrorism, as dozens of agents from the FBI, Joint Terrorism Task Force, Homeland Security, Department of Defense, ATF, and numerous other law enforcement agencies raided his home, seizing his personal and professional belongings. After a federal grand jury refused to charge Kurtz with bioterrorism, Kurtz and Ferrell were indicted on two counts of mail fraud and two counts of wire fraud concerning the acquisition of  of harmless bacteria for one of Critical Art Ensemble&#8217;s educational art projects. (Critical Art Ensemble is the recipient of numerous awards for its projects, including the prestigious 2007 <a href="http://www.creative-capital.org/index2.html">Andy Warhol Foundation Wynn Kramarsky Freedom of Artistic Expression Grant</a>, in recognition of twenty years of distinguished work.).</p>
<p>The Department of Justice brought the charges in spite of the fact that the alleged &#8220;victims of fraud&#8221;&#8211;American Type Culture Collection and the University of Pittsburgh&#8211;never filed any charges or complained of any wrongdoing, and the fact that in bringing the charges the Department of Justice was acting completely outside its own Prosecution Policy Relating to Mail Fraud and Wire Fraud<br />

I went a little contest crazy in my spare time these last few months and did ridiculous things like a <a href="http://wowcool.com/engine/2008/04/14/nickname-rebel-versioning-radioheads-nude/">Radiohead Remix</a> and even <a href="http://wowcool.com/engine/2008/03/04/nickname-rebel-r-is-for-riot-album-is-done-rpm-challenge-success/">wrote and recorded a whole record</a> in February. <strong>When I saw that my favorite web comic <a href="http://www.scarygoround.com/">Scary Go Round</a> was having a reader created comic contest called <a href="http://www.scarygoround.com/feats2008.php">Feats of Strength</a>, I couldn&#8217;t resist.</strong> However, trying to write, draw and color the whole thing in 3 nights right after 2 12+ hour drives between New York and Tennessee was very ill advised; and, it shows in the finished product and in my showing in the contest. Still, I&#8217;ll take 23 (my lucky number) in a field of 54. I think I was eventually more scared it would win, and people would see me at my worst. Well, here I am showing it anyway. So yeah&#8230; up &#8217;til 3 am every night&#8230; arm in total agony&#8230; It was seriously an &#8216;I&#8217;ll fix it in the inking&#8221;&#8230; then &#8216;I&#8217;ll fix it in the coloring&#8217; kind of rationalization going on. The bizarre and garish color choices don&#8217;t help. Not my best work. Still, I think it&#8217;s a pretty cute little strip. Enjoy!</p>

I&#8217;ve finally had a [minor] breakthrough on setting up the new Wow Cool online shop [7 months in the making!] So I feel a little more confident to do this announcement thing. Wow Cool is moving back to California and regular operation after nearly a decade of slagging off in New York and Tennessee. By August, 2008, there will be a new Wow Cool office somewhere in Santa Clara County, the web shop will be gloriously relaunched, and hopefully I can make a preliminary announcement about new releases [music, books, video] that will be rolling out. Stay tuned, dear reader. Buy me a drink at the Hilton bar during Heroes Con if you want more dirt. Or just stop by the table.</p>

The songs are ridiculous: the groans at the beginning of each one were deafening. The &#8220;Piccadilly Lily&#8221; song must have been done 15 times. There is nothing visionary (or even mildly interesting) here, only a long string of poorly-done Fellini ripoffs &#8212; actually, that&#8217;s the whole movie. It was like a train wreck. This was by far the longest hour and 45 minutes of my life. The movie made me long for death. I still am no closer to understanding pogs or Babylon 5, but that&#8217;s OK. Thanks for the job. Thanks for the rides (to San Diego several times). Thanks for loaning me the van (sorry it got broken into). Thank you for having the faith in me and Josh to help make Wow Cool a (sort of) successful distributor in the 90s. Thanks for being our best landlord&#8230; and customer. Thank you for having the vision to hire a knowledgeable staff of specialized buyers for your store and making it one of the best resources of that kind. Thanks, also, for having a nice looking store with a friendly and helpful staff. There aren&#8217;t too many places (if any others) I used to work at that I could say that it was nice to return for a visit. <p>&#8220;Totally weird one. I get the idea that this is a jape, but if so, it&#8217;s a jape so beautifully and elaborately crafted that it stands as a wonderfully crazy art project in its own right. Packaged in a Folkways-style 10&#8243; sleeve with accompanying booklet, this is said to represent the recorded legacy of a drifter named Frank Budgen, about whom little is known, except that he called Troy, NY home for a while, early in the 21st century. There are six tracks, with heavy blues guitar, drums and vocals in a blown style reminiscent of Michael Yonkers, George Brigman and even The Workdogs. It&#8217;s wild lo-fi style, regardless of its actual provenance. And the care taken with the presentation is certain to appeal to cultists of most known stripes. Released in a numbered edition of 99, it&#8217;s a real brain rattler, which features one of the screwier Beefheart covers you&#8217;ll hear in this lifetime.&#8221;</p>

Been trying to find the style for a new draw on an old old script for a promotional mini that I&#8217;m doing as a split release with <a href="http://www.poopsheetfoundation.com/">Poopsheet</a>. discovered that my old pad of bristol was a bit too old and had sucked up some moisture or something as ink is bleeding on it more than I like. So, blew through those last 3 sheets with some style sketches&#8230; that were more doodle than anything thought out. This one had a great logo in outline that got pretty thoroughly ruined by filling it. Looking at the drawing today, I think it is supposed to be Ed Brubaker.</p>

<p>I was very sad today to read of the passing of Bob Rauschenberg. He has always been an artist who in some hard to define way has been an influence. He was partially the real life Frank Beam (if you know, you know). As I&#8217;ve been rediscovering the act of flowing ideas on to paper through pen and brush lately (yeah, sorry, low web activity because of that&#8230; that will continue for at least a couple of more weeks) this news hits me a bit on the side of the head for some reason.</p>

<p><strong>NOISE! 2008</strong><br />
 May 8, 2008: 10 p.m. – May 11, 2008: 1 a.m. at <a href="http://www.ontological.com/">Ontological Theater</a>, St. Mark&#8217;s Church, 131 E. 10th St., Manhattan, NY $10 admission; free video and audio online.</p>
<p>Noise! is a sound performance festival started in 2005. free103point9 curates for the second year. Each year the &#8220;Incubator&#8221; program at Ontological Theater hosts a Noise! festival, a three-night multi-arts event designed to promote interest in new forms of sound art.<br />
The festival will feature short compositions and performances by established and emerging artists.<br />
Each evening opens with a Radio 4&#215;4 as the audience enters the theater.<br />
Radio 4&#215;4 is a free103point9 collaborative radio transmission performance. Four simultaneous audio performances are separately sent through FM transmitters to radios positioned throughout a performance space. Each radio receives only one of the signals, so that the audience becomes an active collaborator in the performance, &#8220;mixing&#8221; the audio feeds by moving about the space among the four signals. Other artists will perform each evening. Tianna Kennedy, Tom Roe, and Damian  Catera will curate each evening. Streamed live on <a href="www.free103point9.org">free103point9 Online Radio</a>.</p>

<p>&#8220;Art (does not equal) Terrorism&#8221; goes beyond the sound bites to find out what happened when an Iraqi artist came to Troy, NY only to be censored&#8211;not once, but twice.</p>
<p>First, Wafaa Bilal was chased off campus after his artwork was mis-characterized as terrorist propaganda by undergraduate bloggers.</p>
<p>When the exhibition was given refuge by The Sanctuary for Independent Media, the city government responded by shutting down the space.
